The Bizzy® Cold Brew Bizzy’est Person in America is a merit-based contest.

1. Eligibility

The Contest is open only to legal residents of the United States who are 18 years of age (19 in AL or NE) or older at time of entry. Void where prohibited by law.

Employees of Get Bizzy, Inc. or any of its respective parents, affiliates, subsidiaries, advertising agencies, or any other company or individual involved with the design, production, execution, or distribution of the Contest, and the immediate family (spouse, parents and step-parents, siblings and step-siblings, and children and step-children) of such employees are not eligible. The Contest is subject to all applicable federal, state, and local laws and regulations. Participation constitutes entrant’s full and unconditional agreement to these Official Rules and Sponsor’s decisions, which are final and binding in all matters related to the Contest. Being voted as a Contest winner is contingent upon fulfilling all requirements set forth herein.

3. Contest Entry Period

Contest entry begins on June 1, 2024, at 12:01 AM Central Time (“CT”) and ends on July 27, 2024, at 11:59 PM CT (the “Contest Entry Period”). Sponsor’s computer is the official timekeeping device for the contest.

4. How to Enter

  1. Contest Application Submission. To enter the Contest, you must visit our Contest Website: bizzycoldbrew.com/BPA (“Contest Website”). Next, follow the online instructions to complete the entry form by providing all of the required Contest information requested on the Contest Website (including, without limitation, your full name, mailing address, date of birth, email address, and a description, as per the entry form instructions, on why you should be the winner of Bizzy’est Person in America), and accepting the Official Rules. Once you submit your completed entry form you will receive one Contest entry. Your Contest Entry form must be submitted before the Contest Entry Period ends.
  2. No Purchase Necessary. You may participate in the Contest simply by providing the information required on the Contest entry form and submitting your completed form before the Contest Entry Period ends.
  3. Internet and Wireless Service Charges. Participants must have a computer, smart phone or other web-enabled device that enables them to submit their completed entry form. Participants who submit a completed entry form may incur data charges from their internet, mobile or other wireless service provider for their Contest submission, depending on their service plan. Participants are solely responsible for any such charges associated with such use, including the downloading (if applicable) and use of the Contest information. Check with your internet, mobile or other wireless service provider for details on these and any other applicable charges. Mobile entry is not required to submit an entry or win a prize in this Contest.
  4. One Entry per Person. Limit of one Contest entry per person during the Contest Entry Period. You may only use one email address to enter the Contest. The name of the person submitting the entry into the Contest must be the authorized account holder of the email address used to enter, otherwise, entry may be deemed void. Multiple participants may not share the same email address. Entries must be manually key-stroked by the entrant; use of automated entry devices or programs, or entries by third parties by any method of entry, are prohibited. Entries that do not conform to or that violate these Official Rules or are submitted in any manner other than stated in these Official Rules will be disqualified. Sponsor will not be responsible for late, lost, incomplete or misdirected entries. By entering this Contest, entrants agree to these Official Rules and the decisions of the Sponsor, which are binding and final in all matters relating to the Contest.

5. Voting Period

Voting on Contest participants begins on August 1, 2024, at 12:01 AM CT and ends on August 22, 2024, at 11:59 PM CT (the “Voting Period”). Sponsor’s computer is the official timekeeping device for the Contest.

6. How to Vote and Voting Criteria

  1. Who Can Vote. People who sign up for an account on bizzycoldbrew.com/rewards (the “Rewards Website”) will automatically become a Rewards Member and be able to earn points, and therefore will be qualified to vote in the Contest during the Voting Period. Only Rewards Members can vote in the Contest.
  2. Becoming a Rewards Member. To sign up as a Rewards Member, you will need to visit the Rewards Website where you can register for an account. To register, you will need to enter your first name, last name, email address and agree to the Bizzy Rewards terms and conditions. By submitting your registration for an account, you also agree to be bound by the Official Rules. Once you have created your account, you will be a member of the Bizzy Rewards Program and will be eligible to vote for the Bizzy’est Person in America.
  3. Rewards Points. When you first sign up as a Rewards Member, you will receive points. Rewards points can be redeemed for votes in the Contest or other items. Please see the Rewards Website and the Bizzy Rewards terms and conditions for additional information on earning and redeeming points.
  4. Voting. Only Rewards Members can vote for the Bizzy’est Person in America. Anyone who wishes to vote must use Rewards points to vote. Rewards Members can vote by redeeming 10 points for each Contest Vote (for example, a Rewards Member who wants to cast 4 votes must redeem 40 Rewards points). Rewards Members: you can vote as often and as many times as you want, so long as you have enough Rewards points for the number of votes you wish to cast. Your votes will not be cast if you do not have enough Rewards points.
  5. Bizzy Rewards Terms. Additional terms and conditions apply to Bizzy Rewards Members. See the http://www.bizzycoldbrew.com/rewardsterms for additional terms and conditions.
  6. No Purchase Necessary. No purchase is necessary to register for Bizzy Rewards or to cast any votes for Contest Winner(s).
  7. Voting Criteria. In casting your votes, you should vote for those contestants who appear to be the Bizzy’est Person in America. You may consider any content submitted by Contestants or posted on our Website.
  8. Prospective Voters will have access to information submitted by each Contestant, including the Contestant’s full name, and any descriptions submitted by each Contestant on why they should be the winner of Bizzy’est Person in America
  9. Internet and Wireless Service Charges. Bizzy Rewards Members must have a computer, smart phone or other web-enabled device that enables them to sign up for Bizzy Rewards and submit Contest votes. Each Bizzy Rewards Member who wishes to vote may incur data charges from their internet, mobile or other wireless service provider for their voting submissions, depending on their service plan. Bizzy Rewards Members are solely responsible for any wireless charges associated with such use, including the downloading (if applicable) and use of the contest information. Check with your internet, mobile or other wireless service provider for details on these and any other applicable charges. Neither, mobile entry nor mobile voting is required to submit a vote in this Contest.
  10. Email Address. You are required to provide a valid email address when signing up for Bizzy Rewards and to become a voter. The name of the person submitting for entry into the Bizzy Rewards program, and/or the Contest votes, must be the authorized account holder of the email address used to vote, otherwise, votes may be deemed void. Multiple Bizzy Rewards Members may not share the same email address. Votes must be manually key-stroked by the voter; use of automated devices or programs, or votes by third parties by any method of voting, are prohibited. Votes that do not conform to or that violate these Official Rules or which are submitted in any manner other than as stated in these Official Rules will be disqualified. Sponsor will not be responsible for late, lost, incomplete or misdirected Contest votes. By participating in Bizzy Rewards and/or this Contest, Bizzy Rewards Members agree to these Official Rules and the decisions of the Sponsor, which are binding and final in all matters relating to this Contest.

Selection of Winners

Contest Winner(s) will be determined based on who receives the most votes during the Voting Period. Any tied votes will be resolved by Bizzy in its sole discretion. Sponsor’s computer is the official voting register device for the Contest. On or about September 29, 2024, the Sponsor will announce the Contest Winners for each prize described below.

POTENTIAL WINNERS WILL BE NOTIFIED VIA EMAIL AND WILL BE REQUIRED TO RESPOND WITHIN 3 DAYS OF NOTIFICATION VIA EMAIL. The potential winners will be contacted using the email address provided with their Contest entry form (subject to verification of eligibility and compliance with the terms of these Official Rules). Potential winners will be notified approximately 5 days after the Voting Period ends. Failure by a potential winner to respond to the initial verification contact within 3 days of notification or return of e-mail notification as undeliverable after 3 attempts may, in Sponsor’s sole discretion, result in disqualification or Sponsor may select an alternate winner, who shall be the person who received the next most votes during the Voting Period. If any potential winner is found to be ineligible, or if he or she has not complied with these Official Rules or declines a prize for any reason prior to award, such potential winner will be disqualified, and an alternate winner will be selected, who shall be the person who received the next most votes. No more than the stated number of prizes will be awarded. Limit of one prize per person for the Contest.

8. Verification of Potential Contest Winners

POTENTIAL CONTEST WINNERS ARE SUBJECT TO VERIFICATION BY SPONSOR WHOSE DECISION IS FINAL AND BINDING IN ALL MATTERS RELATED TO THE CONTEST. Potential winners must continue to comply with all terms and conditions of these Official Rules and winning is contingent upon fulfilling all requirements. Potential winners will be required to sign and return to Sponsor an Affidavit of Eligibility and/or a Liability Release with a publicity release (where lawful) for receipt by Sponsor within 7 business days or by the due date indicated in the notification email. The potential winners will be required to complete an IRS Form W-9 and provide their social security number for tax reporting purposes. All federal, state, and local taxes, if any, related to a prize are the responsibility of the individual winner.

If a potential winner cannot be contacted, fails to sign and return any and all required documents within the required time period, or if the prize or prize notification is returned as undeliverable, then the potential winner will be deemed to have forfeited the prize, and an alternate winner may be selected at Sponsor’s sole discretion. If the potential winner is disqualified for any reason, then the potential winner will be deemed to have forfeited the prize, and an alternate winner may be selected at Sponsor’s discretion. Potential winner must follow the initial prize claim instructions and any subsequent claim instructions, or the prize the potential winner will be deemed to have forfeited the prize, and an alternate winner may be selected at Sponsor’s discretion. Sponsor’s decision as to the administration and operation of the Contest and the selection of the potential winner is final and binding in all matters related to the Contest.

9. Prizes and Prize Conditions

  1. Grand Prize
    One grand prize will be awarded to the person who receives the most votes during the Voting Period. The grand prize winner will receive a cash prize of $50,000 and a one-year supply of Bizzy Cold Brew for themself and up to five (5) team members*. The Grand Prize award will be given to grand prize winner on or around October 1, 2024, but only if the winner first accepts the award in writing upon receiving email notification from Sponsor.
    The Approximate Retail Value (“ARV”) of the Grand Prize is $53,000 including a cash prize of $50,000 and a one-year supply of Bizzy Cold Brew for themselves and up to five (5) team members*.
    *One-year supply of Bizzy Cold Brew is valued at $625 per person, which includes 104 free product coupons, each product coupon good for one (1) free 48 fl. oz. bottle of Bizzy ready-to-drink cold brew.
  2. Runner-Up Prize
    One runner-up prize will be awarded to the person who receives the second most votes during the Voting Period. The runner-up prize winner will receive a cash prize of $15,000 and a one-year supply of Bizzy Cold Brew for themself and up to five (5) team members*. The runner-up prize award will be given to the runner-up prize winner on or around October 1, 2024, but only if the winner first accepts the award in writing upon receiving email notification from Sponsor.
    The ARV of the Runner-Up Prize is $18,000 including a cash prize of $15,000 and a one-year supply of Bizzy Cold Brew for themself and up to five (5) team members*.
    *One-year supply of Bizzy Cold Brew is valued at $625 per person, which includes 104 free product coupons, each product coupon good for one (1) free 48 fl. oz. bottle of Bizzy ready-to-drink cold brew.
  3. Third Prize
    One third prize will be awarded to the person who receives the third most votes during the Voting Period. The runner-up prize winner will receive a cash prize of $5,000 and a one-year supply of Bizzy Cold Brew for themself and up to five (5) team members*. The runner-up prize award will be given to the runner-up prize winner on or around October 1, 2024, but only if the winner first accepts the award in writing upon receiving email notification from Sponsor.
    The ARV of the Runner-Up Prize is $8,000 including a cash prize of $5,000 and a one-year supply of Bizzy Cold Brew for themself and up to five (5) team members*.
    *One-year supply of Bizzy Cold Brew is valued at $625 per person, which includes 104 free product coupons, each product coupon good for one (1) free 48 fl. oz. bottle of Bizzy ready-to-drink cold brew.
  4. Prizes for 4th Place and 5th Place
    One prize will be awarded to each person who receives the fourth (“4th Place”) and fifth (“5th Place”) most votes during the Voting Period. The One prize will be awarded to one (1) 4th Place and one (1) 5th Place Winner will receive a one-year supply of Bizzy Cold Brew*. The 4th Place and 5th Place awards will be given to 4th Place and 5th Place Winners on or around October 1, 2024, but only if the respective winner first accepts his or her award in writing upon receiving email notification from Sponsor.
    The ARV of each individual 4th and 5thplace prize is $625 per person and is a one-year supply of Bizzy Cold Brew for themself*.
    *One-year supply of Bizzy Cold Brew includes 104 free product coupons, each product coupon good for one (1) free 48 fl. oz. bottle of Bizzy ready-to-drink cold brew.
  5. Prize Conditions
    All awards are subject to availability and change. Each winner must accept his or her prize as stated by Sponsor, on the dates specified above. No alternative dates or compensation is available. If the winner is unable or unwilling to accept the prize, the prize may be forfeited and awarded to an alternate winner. Winner is responsible for all incidental expenses not included herein, including any incidental costs or expenses related to participation in this prize. Each prize is non-transferable. No substitution, cash redemption, assignment or transfer of prize permitted, except by Sponsor, who reserves the right in its sole discretion to substitute a prize with another prize of greater or equal value. Sponsor bears no responsibility if any event, element, or detail of a prize is delayed, canceled, postponed or becomes unavailable for any reason. Should any event, element, or detail of any Contest prize become unavailable, the Sponsor shall have no obligation to the winner aside from providing the remaining portion of the prize, minus any unavailable event, element or detail. Each winner must abide by all Contest policies and regulations. Resale, transfer, exchange of any Contest prize is strictly prohibited. Sponsor is not responsible for lost or damaged prize delivery. All federal, state, and local taxes, if any, related to any prize is the responsibility of the individual winner. Any and all guarantees and warranties are subject to the manufacturers or service provider’s terms and conditions, and the winner agrees to look solely to such entity for any such warranty or guarantee claim.

10.Entry Conditions and Release

By submitting a Contest entry form during the Contest Entry Period and entering into the Contest and by voting for Contest participants during the Voting Period, each participant agrees to: (a) comply with and be bound by these Official Rules and the decisions of the Sponsor which are binding and final in all matters relating to this Contest; (b) release and hold harmless the Sponsor and each of its parents, subsidiary, and affiliated companies, the prize suppliers and any other organizations responsible for sponsoring, fulfilling, administering, advertising or promoting the Contest and all of their respective past and present officers, directors, employees, agents and representatives (collectively, the “Released Parties”) from and against any and all claims, expenses, and liability, including but not limited to negligence and damages of any kind to persons and property, including but not limited to invasion of privacy (under appropriation, intrusion, public disclosure of private facts, false light in the public eye or other legal theory), defamation, slander, libel, violation of right of publicity, infringement of trademark, copyright or other intellectual property rights, property damage, or death or personal injury arising out of or relating to a participant’s entry, creation of an entry or submission of an entry, participation in the Contest, acceptance or use or misuse of prize ((including any activity related thereto) and/or the broadcast, exploitation or use of entry; and (c) indemnify, defend and hold harmless the Released Parties from and against any and all claims, expenses, and liabilities (including reasonable attorney fees) arising out of or relating to an entrant’s participation in the Contest and/or entrant’s acceptance, use or misuse of prize.

Publicity

Except where prohibited, participation in the Contest constitutes winner’s consent to Sponsor and its agents use of winner’s name, likeness, photograph, voice, opinions, hometown, state, and/or any other content from contest submission, for promotional purposes in any media, worldwide, in perpetuity, without further payment or consideration.

Content

During the Contest, contestants may submit content or materials on or through our website. All such content must comply with our content standards and user content policy. By submitting such content, each contestant expressly agrees to such content standards and user content policy.

By submitting such content, each contestant represents and warrants to us that:

  • Such contestant owns or controls all rights in and to such content,
  • Such contestant has the right to grant to us the license described in our user content policy,
  • All content submitted by such contestant does and will comply with our Terms, our content standards and user content policy, and all applicable laws,
  • No content submitted by such contestant will violate any intellectual property rights (including trademarks or copyrights) or any other person, and
  • No content submitted by such contestant depicts any individuals who have not granted his or her permission to be featured in such content.

13. General Conditions

Sponsor reserves the right to cancel, suspend and/or modify the Contest, or any part of it, if any fraud, technical failures or any other factor beyond Sponsor’s reasonable control impairs the integrity or proper functioning of the Contest, as determined by Sponsor in their sole discretion. Sponsor reserves the right in its sole discretion to disqualify any individual that Sponsor finds to be tampering with the entry process, the voting process or the operation of the Contest or to be acting in violation of these Official Rules or any other promotion or in an unsportsmanlike or disruptive manner. Sponsor reserves the right to disqualify contest entrants and votes cast by voters. Any attempt by any person to deliberately undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

By using our Websites to enter into the Contest, vote, accept and award or otherwise participate in the Contest, you agree to our Terms and Conditions.

Limitations of Liability

The Released Parties are not responsible for: (a) any incorrect or inaccurate information, whether caused by entrants, voters, printing errors or by any of the equipment or programming associated with or utilized in the Contest; (b) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines, or network hardware or software; (c) unauthorized human intervention in any part of the entry process, voting process or any other part of the Contest; (d) technical or human error which may occur in the administration of the Contest or the processing of entries or votes; or (e) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from an individual’s participation in the Contest or receipt or use or misuse of any prize. If for any reason an entrant’s entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another entry in the Contest. If for any reason a Voter’s vote is erroneously deleted, lost, or otherwise destroyed or corrupted, Bizzy will refund points if the Voter proves to Bizzy’s satisfaction that votes were deleted, lost, or otherwise destroyed or corrupted. In event that production, technical, seeding, programming or any other reasons cause more than stated number of prizes as set forth in these Official Rules to be available and/or claimed, Sponsor reserves the right to award only the stated number of prizes by a random drawing among all legitimate, unawarded, eligible prize claims.

15. Dispute Resolution and Governing Law

To the fullest extent permitted by law, by participating in the Contest (as a Contestant, Voter or both), you agree that:

  • any and all disputes regarding the Contest or these Official Rules shall be governed by, and construed in accordance with, the laws of the State of Delaware, without reference to conflicts of laws principles.
  • the federal and state courts located in Delaware will have exclusive jurisdiction and venue;
  • you waive any right of change of venue;
  • any action by you regarding the Contest or these Official Rules will be brought by you individually and not as part of a class action (BY AGREEING TO THESE TERMS, YOU ARE GIVING UP YOUR RIGHT TO PARTICIPATE AS A CLASS REPRESENTATIVE OR CLASS MEMBER ON ANY CLASS CLAIM YOU MAY HAVE AGAINST US INCLUDING ANY RIGHT TO CLASS DISPUTES OR ANY CONSOLIDATION OF INDIVIDUAL DISPUTES);
  • your recovery in any such action will be limited to your actual costs in participating in the Contest (if any), with all rights to attorneys’ fees and any and all damages (including special, compensatory, punitive, consequential damages) as well as equitable relief being expressly waived.

SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF CLASS ACTIONS OR LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU.

If the preceding or any other provision of these Official Rules is determined by a court of competent jurisdiction to be invalid, illegal, or unenforceable, it shall be replaced by a substitute provision that most closely approximates the original intent of Bizzy and is valid, legal and enforceable. Such determination of the invalidity / illegality / unenforceability of a given provision shall not affect the remainder of these Official Rules.

16. Privacy

Except as noted in these Official Rules, information collected for this Contest is used only for the purpose of Contest administration and winner notification and will not be re-used, sold or shared except in compliance with Sponsor’s Privacy Policy in any manner by the Released Parties or any third parties unless you have elected to receive additional information or promotional material from the Sponsor, or a third party. By participating in the Contest, participant agrees to all of the terms and conditions of the Sponsor’s Privacy Policy, which is available at [https://bizzycoldbrew.com/pages/terms-and-conditions]. In the event of any discrepancy between the Sponsor’s Privacy Policy and these Official Rules, these Official Rules shall control and govern

17. Winners List

For the Winners List, email your request to Rewards@bizzycoldbrew.com with the subject line containing “Bizzy’est Person in America Contest”. Requests for the winner list must be received by October 31, 2024.

18. Employees and Related Parties

Employees, officers, directors, agents and representatives of Sponsor, and their respective affiliates, owners, subsidiaries, shareholders, officers, directors, agents, representatives and employees, and each such individual’s immediate family members (mother, father, sister, brother, any child, husband, wife and their respective spouses, regardless of where they reside) and those living in their same households, whether or not related, are not eligible to participate or win a prize.
